This Article offers a new account of First Amendment doctrine that better aligns the First Amendment with the social harm of misgendering. It paints a picture of the misgendering of gender minorities as a troubling of the social order: not as an exercise of free speech, but of racial, ethnic, and sexual subordination. Such an accounting of harm is necessary for the realignment of First Amendment doctrine, as well as for understanding how to grapple with misgendering in light of contemporary legal theory and practice. Finally, it offers a viable alternative to the modern-day legal academy and the modern-day court: an alternative that is grounded in the long history of struggles by gender minorities to live as full citizens in the U.S. And it brings forth the real dangers and insecurities that people of gender minorities already experience in their day-to-day lives.
Even as hate speech law has undergone dramatic transformation, the legal academy has largely acquiesced to its tide and has largely disregarded victim-blaming as a category of protected speech. While drawing from the accounts of a range of gender minorities, this Article offers a more holistic view of victim-blaming, the not-so-subtle and persistent influence of which endures in the lives of individuals, all the way to the policies and practices of the legal academy. To rectify this tradition, this Article advances an idea of victim-blaming as a class of speech that ought to be protected. The Article then argues that doing so will not simply be a symbolic gesture, but will, in fact, alter the doctrine of free speech itself.
